1. Nature of the Service

Violent Delights ("the Service", "we", "us") provides access to large language models that have been modified to reduce or remove refusal behaviour, content filters, and related safety fine-tuning ("uncensored" models). The Service is an inference API only. We do not create, curate, review, endorse, or control the text generated by the models.

2. No Content Moderation

Model outputs are not filtered, moderated, or reviewed by us. Outputs may include material that is offensive, disturbing, harmful, misleading, defamatory, obscene, or otherwise objectionable, including material you did not intend to solicit. The absence of refusals is a deliberate property of the models we serve. If you are not prepared to receive such outputs, do not use the Service.

3. No Warranty

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. Model outputs may be factually incorrect, fabricated, biased, or nonsensical. You must not rely on any output as professional, legal, medical, financial, or safety advice, and you are solely responsible for verifying any output before acting on it.

4. User Responsibility and Lawful Use

You are solely responsible for the prompts you submit and for any use you make of model outputs. You agree to use the Service only in compliance with all laws and regulations applicable to you, including laws concerning content generation, intellectual property, privacy, data protection, and the laws of any jurisdiction in which you or affected third parties are located.

Your use of the Service is subject to our Acceptable Use and Abuse policy, which sets out prohibited uses, the enforcement measures we may take, and how abuse is reported and handled. That policy forms part of these terms. We reserve the right to suspend or terminate access for any user we reasonably believe to be in breach of it, without notice and without refund.

5. No Monitoring Obligation; Cooperation

We do not routinely monitor prompts or outputs. However, we reserve the right to review usage where required by law, in response to valid legal process, or to protect the security and integrity of the Service, and to disclose information to competent authorities where legally required.

6. Third-Party Models and Marks

The Service runs publicly released checkpoints of third-party models. Violent Delights is not affiliated with, endorsed by, or sponsored by Moonshot AI, Alibaba, Zhipu AI, or any other model publisher. Model names and marks belong to their respective owners. Your use of outputs derived from third-party models may also be subject to the licence terms imposed by the relevant model publisher, and you are responsible for complying with those terms.

7. Limitation of Liability

To the maximum extent permitted by mandatory applicable law, in no event shall Violent Delights, its operators, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service or any model output, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of the Service shall not exceed the amount you paid to us in the three months preceding the event giving rise to the claim.

Nothing in this disclaimer excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) damage caused by our wilful misconduct or gross negligence; (c) fraud or fraudulent misrepresentation; or (d) any other liability that cannot be excluded or limited under mandatory Finnish or European Union law, including mandatory consumer protection law.

If you are a consumer, the "as is" provisions of section 3 and the limitations in this section apply only to the extent permitted by the mandatory consumer protection laws of your country of residence, and do not affect any statutory rights you may have that cannot lawfully be waived.

8. Indemnification

You agree to indemnify, defend, and hold harmless Violent Delights and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your prompts, your use of model outputs, or your breach of this disclaimer or of any applicable law.

9. European Union Users

The Service is operated from Finland and is subject to the law of the European Union and its member states. If you build products or services on top of the API, you are responsible for your own compliance with Regulation (EU) 2024/1689 (the EU AI Act), including the prohibited-practice rules in Article 5 and any transparency, risk-management, or registration duties that apply to your use case. This disclaimer does not discharge any obligation imposed on you or on us by that Regulation.

Nothing in this disclaimer affects any mandatory rights you enjoy under EU or member-state consumer protection law, including Council Directive 93/13/EEC on unfair terms in consumer contracts. Where a provision of this disclaimer conflicts with such a mandatory right, the mandatory right prevails.

10. Privacy

Prompts and outputs may contain personal data. Our processing of personal data is described in our Privacy Policy, which forms part of these terms. If you submit personal data relating to third parties, you are responsible for having a lawful basis to do so and for complying with the General Data Protection Regulation (EU) 2016/679.

11. Governing Law and Jurisdiction

This disclaimer and any dispute arising out of or in connection with the Service shall be governed by the laws of Finland, excluding its conflict-of-laws rules. The courts of Helsinki, Finland shall have exclusive jurisdiction, except where mandatory EU or member-state consumer law gives you the right to bring proceedings in the courts of your country of residence, in which case that right is unaffected.

12. Changes

We may update this disclaimer from time to time. The version posted on this page, with its stated revision date, is the version in force. Continued use of the Service after an update constitutes acceptance of the revised terms.

13. Severability

If any provision of this disclaimer is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
